What Does Colorado Consider to Be Harassment?
Under Colorado law, a person can be charged with harassment by striking, shoving, kicking or otherwise touching someone without their consent in a nonsexual manner.
Harassment can occur under the following scenarios:
- Hitting, shoving, kicking, or touching a person without consent;
- Yelling obscene language or making an obscene gesture at someone;
- Following someone in public who does not wish to be contacted;
- Calling someone with the intent to harass, annoy or alarm them, or threaten bodily injury or property damage;
- calling someone repeatedly, contacting someone consistently at inconvenient hours, and
- using insulting or using offensive language at someone, insulting, taunting, or challenging someone;
If the person charged is accused of harassment and the alleged victim is someone they have or had an intimate relationship with (i.e., spouse, former spouse, significant other, boyfriend, girlfriend, etc.), it will be deemed domestic violence, which is a sentencing enhancer.
America does allow for the freedom of speech, however, that does not permit people to harass and threaten other people.

Consequences of harassment in Colorado
Under Colorado revised statute 18-9-11, harassment is generally considered a class 3 misdemeanor in Colorado, which can result in six months in jail and up to $750 in fines.
If the harassment includes intimidation due to a person’s perceived race, color, religion, ancestry or national origin, the charge is enhanced to a class 1 misdemeanor, which can result in 6 to 18 months in jail and up to $5,000 in fines.
