DUI Breath & Blood Test Lawyers in Colorado Springs
Finding yourself under arrest for a DUI is often a terrifying, disorienting experience. Seeing a chemical test result flash on a screen or knowing your blood sample is sitting in a state lab can make it seem like the system has already decided your fate.
It hasn't.
At Black, Blink, & Associates, our legal team has found that DUI charges do not automatically result in convictions. Breath and blood tests can be erroneous or misapplied. Medical conditions can skew blood alcohol concentration (BAC) results. Police officers make procedural mistakes, breathalyzers fall out of calibration, and blood samples get contaminated.
Assuming the evidence against you is airtight is a mistake. Our team knows how to find the weaknesses and flaws that undermine the state’s claims. Our former prosecutors understand how the state builds its cases and, with decades of combined experience, we know that chemical testing is far from infallible.
We approach every DUI case by aggressively auditing the science and the police work behind your arrest. When your driver’s license, your record, and your freedom are on the line, you need a defense team that knows how to pick apart faulty evidence and fight for your future.

What You Need to Know About Chemical Testing
Under Colorado’s express consent laws, anyone who drives on public roads is legally deemed to have given consent to submit to a chemical test (breath or blood) if an officer has probable cause to suspect driving under the influence.
When you are pulled over and suspected of a DUI, officers will typically request field sobriety tests and a roadside portable breath test (PBT). If arrested, you will be asked to choose between a formal breath test and a blood test to measure your blood alcohol concentration (BAC).
- DWAI vs. DUI: If your test registers between .05 and .079 BAC, you may be charged with Driving While Ability Impaired (DWAI). If your result is .08 BAC or higher (.02 or higher for minors), you face charges for Driving Under the Influence (DUI) or DUI per se.
- The breath sample process: Formal breath testing at a police station, mobile unit, or facility requires two breath samples into a desktop machine (such as the Intoxilyzer 9000). The lower of the two results is used in your criminal charging documents.
