The accusations were severe. Our client was alleged to have used a firearm to kidnap and sexually assault the alleged victim, charges that carried the potential for life-altering consequences and mandatory prison time. From the beginning, Peter recognized that the Prosecutor’s theory was inconsistent with the physical evidence collected from the victim.
During the investigation, DNA testing revealed three unknown male contributors found on the victim. Critically, none of the DNA matched our client. This fact was known to the District Attorney, law enforcement, and investigators for nearly two years, yet the prosecution chose to move forward with the case and ignore the presence of these unknown contributors, who were never identified or investigated.
Peter committed himself to an exhaustive review of the discovery, meticulous analysis of the DNA evidence, and constant communication with his client. He understood that the key to revealing the truth in this case was not just legal skill, but the ability to make the jury see what the evidence proved, and more importantly, what it failed to prove.
After two jury trials, Peter’s tenacious advocacy prevailed. The jury agreed that the prosecution failed to meet its burden of proof and that the evidence did not support the allegations. Our client was acquitted of all charges.
